Vaquero v. Stoneledge Furniture (2-28-17)

CA Court of Appeal held that paying a non-exempt commissioned employee a draw against future commissions may deprive such workers of their paid rest breaks.  The court held that a draw is a loan, and a loan is not a wage and is subject to repayment.  Thus, non-exempt commissioned employees should be paid minimum wage for their paid break times, outside of their regular draws against future commissions.
