Anti-Sexual Harassment Supervisor Training Must Now Include Training On Prevention Of Harassment Based On Gender Identity, Gender Expression And Sexual Orientation
On October 15, 2017, Governor Brown signed SB 396. The California Fair Employment and Housing Act already requires employers with 50 or more employees to provide at least 2 hours of training regarding sexual harassment to all supervisory employees within 6 months of their assumption of a supervisory position and once every 2 years. Under SB 396, these larger employers will now be required to include in such supervisor training sessions education to prevent harassment based on gender identity, gender expression, and sexual orientation. Also, employers with 5 or more employees will need to post a new poster regarding transgender rights (when such poster is created by the DFEH).
